Attendance and

Cancellation Policy

This Attendance and Cancellation Policy applies to your attendance at the Lubricus 2021 conference in Portland, OR (“Lubricus"). By attending Lubricus, you hereby agree to the terms and conditions set forth in the Attendance and Cancellation Policy.

 

Registration

One (1) registration entitles you to admission to all Lubricus programming events, admission to the Lubricus Blue Ball, drink tickets redeemable at the Blue Ball, and admission to the Morning After Breakfast.

 

Cancellation

 

Registrations may be cancelled any time before September 29, 2021 by sending an email to registration@bf4f.org with the following subject line: CANCELLATION.  In the event of a proper cancellation before September 29, 2021, BF4F will provide the cancelling registrant with a refund of 95% of the registration fee.  The cancelling registrant’s spot will be offered to the next person on the waitlist if a waitlist exists. Cancellations will not be accepted after September 29, 2021 and no refunds after September 29, 2021 will be issued. Refunds of hotel rooms are subject to the terms and conditions of the hotel’s cancellation policy.

 

Restrictions

The programming, events, and activities at Lubricus are intended primarily for adults. You must be at least 18 years of age as of October 21, 2021 to attend Lubricus. If BF4F becomes aware of a person under the age of 18 attempting to provide BF4F with information or attend Lubricus, BF4F will use reasonable efforts to remove the information permanently from our files and restrict access to Lubrics. BF4F reserves the right to refuse entry to any registrant who disrupts Lubricus, exhibits violent behavior, or otherwise causes it to be brought into disrepute. While debate is accepted and encouraged, any registrant acting in an abusive fashion to another person will be asked to leave.

Content

You understand that all information including but not limited to registration information submitted with regard to Lubricus, submission information provided by you that concerns or regards participation as a speaker, panelist or participant in any portion of Lubricus, data, text, graphics, messages or other materials (“the Content”) are the sole responsibility of the persons from which such Content originated. You understand that by attending Lubricus, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will BF4F be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any kind.

Code of Conduct

 

BF4F does not tolerate discrimination or harassment of any kind, including but not limited to physical assault, battery, deliberate intimidation, stalking, inappropriate language, or unwelcome physical contact. This policy applies to any attendee’s interactions with fellow con-goers, program participants, hotel employees, and guests of the hotel. Be respectful of and courteous towards others. Attendees are expected to understand that one needs to ask before touching and that “no” means “no”. If someone says “no” or “go away”, an attendee’s business with that person is done.

 

Violation of this policy can result in action by the convention committee ranging from warnings to having the violator’s badge revoked with no refund, and the decision of the event committee is final. Action by the convention in no way precludes the injured individual or the hotel from pursuing whatever remedies, civil or criminal, they see fit. After the event, BF4F may take further action, including banning the violator from further events. Please note that other behaviors, including but not limited to destruction of hotel property, can also result in the actions described above.

 

If you experience harassment or other unwanted behavior, please visit Registration in the Common Room to discuss or report an incident or concern. We strongly encourage attendees to report an incident as soon as possible after it occurs.

 

Weapons and Props

BF4F does not allow real weapons either as part of a costume or for everyday convention wear. Examples include, but are not limited to, real firearms, ammunition, tasers, pepper spray, or other real weapons. The Lubricus con com and staff have the final say on what items require peace-bonding or removal to safe storage.

We reserve the right to inspect and reject any prop and/or device at any time. Violation of this policy in part or in whole may lead to your removal from the convention by convention staff and/or from the hotel by hotel security or local authorities. Banned items include:

  • Functioning projectile weapons, devices, or toys, including items meant to be thrown (See information for disabled projectile weapons below.

  • Firearms or projectile items that look like real or functioning weapons from 10 feet away

  • Live steel

  • Props made of metal

  • Potentially dangerous props which are not part of a bona fide costume

  • Props wide or long enough to inhibit movement in con spaces

The Lubricus committee and staff have the final say on what items require peace-bonding or removal to safe storage.

 

Indemnity

You agree to indemnify and hold BF4F, and its subsidiaries, affiliates or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your attendance at Lubricus.

 

Privacy Policy

For all purposes, the Lubricus Privacy Policy (“Privacy Policy”) applies to all activities relating to Lubricus. Your use of the BF4F Website and attendance at Lubricus signifies your continuing consent to the Privacy Policy, which can be examined here: www.bf4f.org/privacy-policy. Personal information that you supply to BF4F will be subject to the Privacy Policy.

 

Disclaimer of Liability

You hereby understand and agree that: (i) attendance at Lubricus is at your own risk; and (ii) any material (including but not limited to convention programs, crafts, or displayed work) obtained at Lubricus is at your own discretion and your own risk, and that BF4F shall not be liable for any damage that occurs to you or your property as a result of your actions.

 

The services at Lubricus are provided on an "as is" and "as available" basis. BF4F expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. BF4F events are not endorsed, sanctioned or in any way supported, directly or indirectly, by Warner Bros. Entertainment, the Harry Potter book publishers or J.K. Rowling and her representatives.

 

Governing Law and Jurisdiction

The Attendance and Cancellation Policy and the relationship between you and BF4F shall be governed by the laws of the State of California. You and BF4F agree to submit to the personal and exclusive jurisdiction of the courts located within San Francisco county, California.


Waiver and Severability

The failure of BF4F to exercise or enforce any right or provision of the Attendance and Cancellation Policy shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Attendance and Cancellation Policy shall remain in full force and effect.
